We strive to provide a reliable and enjoyable service, which may require us to fix bugs, install updates, and perform general diagnosis and maintenance. However, we cannot guarantee that the Platform and Services will always be problem-free, uninterrupted, free of omission, or error-free. The Materials and function of the Platform and Services are provided on an "as is" basis without any express or implied warranties to the extent permitted by law. Information obtained from the Platform may not always be accurate. We rely on other providers to supply the data upon which we base the information on the Platform. We endeavour to ensure that the data is accurate and up-to-date in partnership with our providers, but we cannot assure that it will always be so. This User Agreement is for the Services provided by Dealz Arabia Trading LLC through their 'Dealz Arabia App' and website www.dealzarabia.com, which operates in the emirate of Dubai, in compliance with the Commercial Companies Federal Decree Law number)32( of 2021 and Law number )13( of 2011 Regulating Economic Activities in the Emirate of Dubai. Dealz Arabia is also referred to as "we", "us", or "our". By accepting this User Agreement, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions set forth in this Agreement for accessing and using the Platform.
The User Agreement and Privacy Policy together form the "Terms" upon which you can access and use the Platform, regardless of the device or technology used to access it. Please note that certain Services available on the Platform may have additional terms and conditions that apply, which will be communicated to you through the Platform.
It is important to note that nothing in these Terms will affect your statutory rights as a consumer, as provided by applicable laws. Please read this Agreement carefully before accepting it.
DEALZ ARABIA APP
The Dealz Arabia App enables you to buy goods and services by registering an account on the Platform. To enter a Draw on the Platform, you need to buy a product offered on the Dealz Arabia App and receive a ticket for entry. Depending on the outcome of the Draw, you may have the chance to win Prizes. To learn more about how our Draw works, please consult the Draw Terms specified in this User Agreement.
When you purchase a product through the Dealz Arabia App, you can select your preferred pickup location from the options available on the Platform. You can then collect the product from the designated pickup point after completing the purchase
PRIVACY POLICY
Before using the Platform, please carefully review our Privacy Policy, which is an integral part of these Terms. As part of using the Platform, any personal information you provide will be subject to our Privacy Policy. We are committed to protecting your privacy and handling your personal information in accordance with applicable laws and regulations. Our Privacy Policy outlines the types of information we collect, how we use and share your information, and your rights in relation to your personal data. We are committed to handling your personal information with care and in compliance with applicable laws and regulations.
ELIGIBILITY FOR MEMBERSHIP
Users of the Dealz Arabia App and Dealz Arabia web app must meet certain requirements to use the Platform. This is necessary to ensure that users are legally eligible to enter into contracts and to prevent minors from accessing unsuitable content. To become a member and use the Platform, you must be at least 21 years old or meet the legal age requirement to enter into a contract in your jurisdiction, whichever is higher. By using the Platform, you acknowledge and confirm that you meet the legal age requirement and that all information you provide is truthful and accurate.
Dealz Arabia reserves the right to refuse, limit, suspend, or revoke membership of the Platform to any user. Additionally, users are not allowed to register more than once as a member on the Platform
REGISTRATION AND MEMBERSHIP OBLIGATIONS
You are not allowed to access the Services and use the Platform without creating an account and registering your information to become a member ("Membership"). By registering, you acknowledge and warrant that the information you provide is accurate and complete, and you will not register under another person's name or attempt to enter the Membership using someone else's identity. Offensive usernames are strictly prohibited and we reserve the right to refuse, limit, suspend, or withdraw Membership or access to the Platform at any time and for any reason.
We do not take responsibility for the accuracy and completeness of your membership information. You must keep your membership information up-to-date and update your details promptly if they change. If you provide any information that is untrue, inaccurate, not current, or incomplete, or if we suspect that such information is not in accordance with this User Agreement, we reserve the right to suspend, limit, or withdraw your membership and/or your access to the Platform.
When creating your membership, you will need to provide certain information and choose a username and password. You are solely responsible for protecting your account and maintaining the confidentiality of your username and password. You must take all reasonable steps to keep your account secure and restrict access to and use of your Platform account and password.
All activities that occur under your account are your responsibility. You will be held accountable for all actions taken in your name if someone else uses your login information. It is strictly prohibited to use anyone else's membership.
You must reimburse Dealz Arabia for any costs, expenses, and damages resulting from improper, unauthorized, or illegal use of your membership and password by you or anyone else who gains access to the Platform using your membership.
You cannot transfer or sell your Membership or account details to another party, and you acknowledge that you are solely responsible for all activity conducted on the Platform through the use of your Membership.

To fulfil our obligations to you under these Terms, we may need to communicate with you via email, other forms of electronic messaging, or by posting notices on the Platform. However, you have the right to refuse electronic communication from us and request that we communicate with you through alternative means. Please note that if you choose to decline electronic communication, it may impact our ability to provide the Services to you.
YOUR USE OF THE PLATFORM
You agree to use the Platform and the Services only for lawful purposes and in accordance with these Terms and any applicable laws, regulations, or policies. You are prohibited from using the Platform or the Services in any way that could damage, disable, overburden, or impair any of our servers or networks, or interfere with any other user's use and enjoyment of the Platform or the Services.
When accessing the Platform or using the Services, you agree to provide accurate, truthful, and complete information. You are not allowed to post false, inaccurate, misleading, defamatory, or libelous content (including but not limited to during the registration process).
You agree to respect the rights of others and to not infringe on their intellectual property rights. You are not allowed to advertise or solicit any user to buy or sell any Services without our prior approval. You are prohibited from transmitting chain letters or junk email to other users, using any information obtained from the Services to contact, advertise to, solicit or sell any products or services to any user without their prior explicit consent, impersonating another user or person, or using the username or account of another user.
You are not allowed to use any information obtained from the Services and Platform to harass, abuse, or harm another user or person. You are also prohibited from accepting payment of anything of value from a third person in exchange for your performance of any commercial activity on or through the Services on behalf of that person.
You may use the Platform in a manner inconsistent with any and all applicable laws and regulations and incur any liability to the Platform or us.
You are not permitted to copy, modify, distribute, sell, or lease any part of our website. Additionally, you are not allowed to reverse engineer or attempt to extract the source code of the website, such as "scraping" the website through automated means or "framing" any part of the website. Furthermore, any attempt to interfere with or disrupt the normal functioning of the website is strictly prohibited..
To be clear, unauthorized attempts to access any portion or feature of the Platform, or any other systems or networks connected to the Platform, or to any of the Services offered on or through the Platform, by hacking, password "mining" or any other illegitimate means, are strictly prohibited and may result in legal action
You agree not to take any action that would impose an unreasonable or disproportionately large load on the infrastructure of the Platform or our systems or networks, or any systems or networks connected to the Platform or to us
To ensure the proper functioning of the Platform and to maintain the integrity of any transactions conducted on the Platform, you agree not to use any device or software to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform or with any other person's use of the Platform
PAYMENT AND REFUND
Your participation in Draws and chance to win Prizes are directly correlated to your purchase of the products and Services available on the Platform. Any refunds requested by you for defective products sold by Dealz Arabia may affect your participation in Draws and chance to win Prizes as set out in more detail in the Draw Terms. Dealz Arabia gives no warranties or representations whatsoever in relation to the exchange rates it provides for any transaction, and is under no obligation to provide the best or most competitive exchange rates available. In such cases where you may be charged in AED or US Dollar depending on where you are using the Platform from and what type of credit or debit card you are using, there may be slight discrepancies in values due to changes in foreign exchange rates. We are not responsible and shall not compensate you for any loss that occurs due to these rate fluctuations. The product prices displayed on our Platform are inclusive of VAT. Multiple transactions by you on our Platform may result in multiple postings to your monthly credit or debit card statement. Please ensure you have read the applicable terms and conditions provided by your bank prior to the transaction if you make a payment for one of our Services available on our Platform. The details you are asked to submit will be provided directly to our payment provider via a secured connection.
INTELLECTUAL PROPERTY RIGHTS
All Materials ("Materials") and Marks ("Marks") contained on the Platform, such as text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and any other content, are owned or licensed by Dealz Arabia and are subject to copyright and other intellectual property rights under UAE and foreign laws and international conventions. The Platform may display content owned by third parties in connection with the Services, which may be subject to a license granted by third parties to Dealz Arabia. You are not permitted to reverse engineer, decompile, or disassemble such content and do not have any rights related to such content.
Materials on the Platform are provided to you for your personal use only and cannot be used for any other purposes without prior written consent from the respective owners. You are not permitted to copy, reproduce, distribute, transmit, broadcast, display, sell, license or otherwise exploit the Materials. Dealz Arabia reserves all rights not expressly granted to the Platform and the Materials.
You agree not to use, copy, or distribute the Materials, including any third-party Materials obtained through the Platform, for commercial purposes. You also agree not to interfere with security-related features of the Platform or features that prevent or restrict the use or copying of any Materials or enforce limitations on the use of the Platform or the Materials therein.
The content displayed on the Platform, including the Services, is protected by copyright as a collective work and/or compilation under copyright laws, other laws, and international conventions. Reproduction, modification, creation of derivative works or redistribution of the Platform, the Materials, or the collective work or compilation is expressly prohibited. Copying or reproducing the Platform, the Materials, or any portion thereof for further reproduction or redistribution is also expressly prohibited.
You acknowledge and agree that you will come across Materials from various sources on the Platform, and Dealz Arabia is not responsible for the accuracy, usefulness, safety, or intellectual property rights of such Materials to the extent permitted by applicable law. You assume all liability for your use of any Materials.
If you believe that any Material on the Platform infringes on your intellectual property rights, you should notify Dealz Arabia immediately, and we will investigate your claim and take appropriate action.
By using the Platform, you acknowledge and agree that Dealz Arabia owns all right, title, and interest in and to the Platform and the Materials, and you will not acquire any ownership or other rights in or to the Platform or the Materials by using the Platform or agreeing to these Terms.

Dealz Arabia is not responsible for any third-party applications, and you acknowledge that such applications may be modified or removed by their original publisher and/or respective rights owner at any time. The use of any third-party application is subject to any terms and conditions provided with such third-party application and is not governed by us. You assume all responsibility and risk of use of any third-party applications (including any content therein) and Dealz Arabia hereby disclaims any and all liability to you or any third-party related thereto. Dealz Arabia does not have any obligation to examine or scan third-party applications, for any purpose, and is not responsible for the accuracy, completeness, appropriateness, or legality of any third-party applications. The fact that a third-party application is available via any online platform or otherwise is not an endorsement, authorization, or representation of Dealz Arabia's affiliation with any third-party, nor is it an endorsement of such third-party application, and you hereby waive any legal or equitable rights or remedies you have or may have against Dealz Arabia with respect thereto. We shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages or loss (including, without limitation, incidental and consequential damages, loss of revenue or anticipated profits, loss of goodwill, loss of business or damages resulting from lost data or business interruption) arising out of the use or inability to use the Platform and the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory. We shall not be responsible for any transaction disputes, including disputes related to quality, safety, breach of warranty, and payment. We shall also exclude any liability for damages caused by any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any communications due to technical problems or traffic congestion on the internet or on the Platform, including any injury or damage to any users or to any person's computer related to or resulting from the use of the Platform. Furthermore, we expressly disclaim all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.
By using our Platform and/or Services, you expressly understand and agree that our maximum liability for any claim against us shall be limited to an amount of AED 100.

INDEMNITY
In the event that any third party asserts a claim, or any action or proceeding is brought against you, in each case, arising from or related to (i) your breach of any provision of this User Agreement; (ii) your breach of any third-party right, including without limitation any copyright, trademark, trade secret or other intellectual property, or privacy right; (iii) your use of the Platform or the Services, or (iv) any claim that the Platform, Services or any Materials caused damage to you or a third-party, you agree to indemnify, defend, and hold harmless Dealz Arabia and its Companies, and its and their officers, directors, shareholders, successors, assigns, agents, service providers, suppliers and employees from and against any and all claims, damages, obligations, losses (whether direct, indirect or consequential), liabilities, costs or debt, and expenses (including but not limited to legal fees). This indemnification obligation will survive any termination, modification or expiration of this User Agreement and your use of the Services and the Platform.
LIMITATION AND TERMINATION OF SERVICES
Dealz Arabia's Services may have usage limits established from time to time, such as the maximum number of days that content will be stored, the maximum number and size of postings or messages, and the frequency of access. Dealz Arabia may modify or discontinue the Service or Platform (or any part thereof) at any time, with or without notice, and will not be liable for any resulting damages to you or any third-party. If your access or use is terminated, you must notify Dealz Arabia of any unauthorized use of your Membership or security breach. Termination or limitation of your access or use will not waive any other rights or remedies to which Dealz Arabia may be entitled at law.
FORCE MAJEURE
We cannot be held responsible for any delays, failures or interruptions to the Services provided on the Platform, or any interruptions to the Platform itself, that result directly or indirectly from circumstances beyond our control, including but not limited to acts of nature, forces or causes beyond our reasonable control, such as internet failures, computer or telecommunications equipment failures, electrical power failures, strikes, labour disputes, riots, civil disturbances, shortages of labour or materials, epidemics, pandemics, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, or non-performance by third parties.
GENERAL INFORMATION
We reserve the right to sever any provision of these Terms that a court of competent jurisdiction deems invalid, illegal, or unenforceable, provided that such severance does not alter the essence of these Terms. In such a case, the remaining provisions will remain in full force and effect.
Any failure by you to comply with the terms outlined in these Terms or other policies with us does not waive our right to enforce those terms.
You may not transfer or delegate any of your rights or obligations under these Terms to any third-party without our prior written consent. However, we may assign, transfer, or subcontract any of our rights or obligations under these Terms to any third-party at our discretion and without notifying or obtaining consent from you.
GOVERNING LAW AND DISPUTE RESOLUTION
The English text will apply in case of any inconsistency between the English text and the Arabic text. These Terms shall be governed by and construed under the laws of the Dubai ecnomic development ("DED"), Dubai, United Arab Emirates. The Terms may be published in both English and Arabic
DEALZ ARABIA DRAW TERMS ("DRAW TERMS")
Such product being donated to charity" will be the consequence if you fail to collect your purchased product from the selected pickup point within seven (15) calendar days from the purchase date as stated on the web/app. Upon collection, you must present your valid identification (e.g. national identification card, passport, driver's license, etc.) as required by Dealz Arabia in its sole discretion. Dealz Arabia may, at its sole discretion, permit an individual who has been given a written, valid, and effective Power of Attorney (POA) by you to collect the product, subject to the presentation of necessary identification. Dealz Arabia will assess any dependence on a POA on a case-by-case basis and cannot guarantee that an individual with a POA from you will be permitted to collect the product on your behalf. On the Dealz Arabia App, each product purchased in compliance with these Terms is associated with a specific type of Draw in which a user is awarded at least a single complimentary ticket ("Ticket") to that specified Draw after purchasing the product. The types of Draws on the Platform differ. Dealz Arabia will double your Ticket entry into the specified Draw, so that two Tickets under your name will be in the Draw, or award you with a fixed amount of credit in the form of Arabian Point, depending on the campaign offer at the time of your purchase if you choose to Contribute the purchased product to a charity of Dealz Arabia's choice. Alternatively, you may opt NOT to contribute the purchased product to charity and instead, collect the purchased product from our collection points. Only users with a valid Membership to the Platform that satisfies all the Terms are eligible to enter into our Draws. Draws will be approved by the relevant authorities in the UAE and are in accordance with the guidelines (as such they may be amended from time to time). Each respective Draw will be given a valid permit number. You acknowledge and accept that it is your responsibility to review these Draw Terms periodically to familiarize yourself with any changes. We may modify these Draw Terms at any time without prior notice, and the amendments will take effect once they have been displayed on the Platform. Your continued use of the Platform and/or entry into Draws following any amendments shall be construed as acceptance of those amendments. The following provisions apply to your participation in our contest Draws ("Draw(s)") and winning the prizes ("Prize(s)"), in addition to your agreement with the Terms.
The date of the Draw is subject to change without notice, and we reserve the right to modify or cancel any Draw at any time, without liability. The Tickets associated with the Draw are non-transferable and non-refundable. You cannot select the Ticket number as it is generated by the computer only after completing the purchase of the associated product. The length of the Draw varies and the Prize is awarded on a date that is subject to change and can occur on any day of the week. The Draw is conducted in the presence of a government representative, and the results are final and not open to dispute or negotiation by users
Upon completion of the specified products associated with the Draw, you will be automatically entered into the Draw. There is no deadline to enter the Draw using your Ticket, and you may enter at any time.
The period of the Draws can be extended at Dealz Arabia's sole discretion, and we will not notify you of any extension.
Winners of the Draws are selected by Dealz Arabia and will be notified on the day the Draw occurs. The names of winners will not be announced in the local and regional press as well as on the Platform and our associated social (online) media profiles, unless you specifically advise us otherwise in writing prior to the Draw. The number of winners per Draw will vary depending on the Draw.
On the Draw day, an email will be sent to the registered email or sent SMS to registered mobile number on the Platform detailing the next steps and how you can claim the Prize. You will need to contact Dealz Arabia to claim your Prize, which may include the following:
The winner of the Prize is required to present valid identification at our premises within 60 calendar days to collect the Prize. If the winner fails to collect the Prize within this time frame, we will transfer the Prize to the government authority. After the transfer, Dealz Arabia will not have any further responsibility with respect to the Prize. If the Prize is transferred, the winner must communicate with the government authority and comply with their terms and conditions.
In the event a winner does not reside in the United Arab Emirates, we will either courier the Prize to the winner by air or land (as we may determine in our sole discretion), or ship the Prize to the winner's country of residence (nearest seaport as selected by us in our sole discretion). We will insure the shipment of the Prize until delivery at the port. However, the winner must pay for the shipping costs in advance, including all local taxes, custom duties, and any other expenses at the port. Collection from the port and clearance through the port and customs shall also be the responsibility of the winner
Once the Prize is handed over to or collected by the courier/handler for international delivery, all risk and responsibility will transfer to the winner. From that point on, we will no longer hold any claim or responsibility for any damage or injury that may occur during transit or upon delivery
Upon winning the Draw, you agree to allow us to use any content created or provided by you, including but not limited to your name, photographs, videos, call recordings, and other materials, for promotional purposes in the local and regional press, on our Platform, and on any associated social media profiles. However, if you wish to withdraw your consent, you may do so at any time, but this may affect your eligibility to participate in future Draws.
Rest assured that all Prizes displayed on our Platform will be awarded exactly as they are presented, with only minor (if any) physical changes.
In the event that registration or transfer of ownership is required for a Prize, it will be registered or transferred solely in the name of the winner as it appears on the winning ticket. By entering such a Draw, you confirm that you meet all required government and regulatory criteria for receiving registration or transfer of ownership. If any winner is subsequently found to be ineligible to participate in the Draw, we reserve the right, at our sole discretion, to reclaim the Prize or dispose of it in a manner and to a person of our choosing, in accordance with applicable laws. We do not accept responsibility for arranging any insurance, including travel insurance, medical insurance, transport, meals, or any other expenses of a personal nature incurred by the winner in the collection of the Prize, unless agreed otherwise in writing by us. We shall not be liable for any claims, damages, or expenses of any nature whatsoever arising from any loss, illness, bodily injury (including death), or defect in any Prize, whether to the winner or any third-party. Winners are solely responsible for any and all tax liabilities that may arise from receiving a Prize, where applicable.
